The agreement is between the client who is named, hereinafter referred to as the “Client” and C I Media, hereinafter referred to as the “Videographers”

General & Payment Terms

  • A written or verbal booking and receipt of the deposit confirms the client booking with the videographer

  • For new clients, we require prepayment in full. A 50% deposit is required to hold your preferred date, the remaining amount is due no later than 48 hours prior to the shoot date

  • For existing clients, a 50% deposit is required before commencing the project. This deposit is non-refundable, but can be held for up to three months in credit towards another project

  • The remaining fee is due on acceptance of the video draft, prior to the finalised video being released. If this is not paid, the videographers reserve the right to withhold your video until all debts are paid. In the event that any monies are outstanding, a late fee of 5% will be charged per month or part month overdue

  • All prices shown do not include GST. GST will be added at the time of invoicing

  • When there is the inclusion of a professional voice over, any alterations requested to the voice over after it has been confirmed, will incur additional charges

  • Changes to any graphic or visual elements after confirmation of the final video is accepted with incur additional charges

  • Re-shoots due to information not provided by you to the videographers will incur additional charges

  • Your video will be filmed and produced based on a brief provided to the videographers or a video strategy written by the videographers

  • Travel within a 30km radius of Cathedral Square in Christchurch is included in our package prices. For locations based outside of this area, a travel fee will be added to the booking

Cancellation: Should the client cancel the videographers services, the following applies

  • Within seven days of the filming date - the full payment is not-refundable

  • Between one month and seven days before the filming date - the deposit amount (or 50% of the prepaid amount) is non-refundable

  • Prior to one month before the filming date - the deposit amount (or 50% of the prepaid amount) can be transferred to another date

  • If the videographers are too ill or become injured and cannot supply the services as agreed, the videographers will do their best to provide a replacement videographer or reschedule the filming date. If a replacement or alternative date cannot be found, any monies paid by the client will be refunded. The videographers cannot be held liable for any losses incurred due to illness or injury.

Inclusions:

  • The clients consent to happily cooperating and communicating to achieve the best possible result. The videographers accept no liability for anything not captured if they were not made aware of it in advance

  • Where aerial filming is included, we will STRICTLY only fly our drone in areas where we can legally and safely do so. Permissions must be gained at least 48 hours prior to the commencement of filming

  • The copyright of raw footage and photos remains with the videographers. Raw footage and photos will not be released. This protects the clients from unedited footage falling into the hands of inexperienced editors

  • The clients grant the videographers consent to use their video footage for promotional purposes

  • If there are adverse weather conditions on the day of filming, the videographers will do their upmost to continue filming as best as they can. However, professional camera equipment has limitations in bad weather. The videographers may contact you prior to the day of filming to arrange an alternative date

  • The videographers are professional editors. They will produce the clients final video and photos in a professional and creative way as per their editing style. If you have specific editing requests, please ensure these are conveyed to the videographers PRIOR to confirming your booking as this may incur additional charges and can impact on the filming style

  • We retain full copyright of all images supplied. Images are provided for approved use only and must not be edited, altered, or retouched by any third party without our written permission. The agreement is between the client who is named, hereinafter referred to as the "Client" and C i Media, hereinafter referred to as the "Producer."

General and Payment Terms

  • A written or verbal booking and receipt of the deposit confirms the client booking with the Producer

  • Deposit amounts and payment milestones are as stated in the project proposal or quote. All deposits are non-refundable under any circumstances

  • Payment milestones are due at the times stated in the project proposal or quote. The Producer reserves the right to withhold delivery until all outstanding amounts are paid in full

  • In the event that any monies are outstanding beyond 14 days of the invoice date, a late fee of 5% will be charged per month or part month overdue

  • All prices shown do not include GST. GST will be added at the time of invoicing

  • Quotes are based on information provided at time of quoting. Final pricing is subject to confirmation of space inclusions, access conditions and any other relevant project details. Material variations in scope may require a revised quote

Cancellation

Should the client cancel the Producer's services, the following applies:

  • More than 30 days before the scheduled capture date: the deposit is non-refundable but may be transferred as a credit toward a rescheduled project within six months

  • Between 15 and 30 days before the scheduled capture date: the deposit is non-refundable and no transfer is available

  • Less than 15 days before the scheduled capture date: all payments made to date are non-refundable and the remaining project balance will be invoiced

  • On the day of capture or during an active project: the full project fee is invoiced immediately

Should the Producer be unable to fulfil the services due to illness, injury or circumstances beyond their control, the Producer will make every reasonable effort to reschedule. If rescheduling is not possible, any monies paid by the client will be held in credit for up to six months. The Producer cannot be held liable for any losses incurred as a result.

Access and Venue Readiness

  • The client is responsible for ensuring all spaces are accessible and available during scheduled capture periods

  • Where applicable, spaces are assumed to be in a presentation-ready condition at the time of capture unless otherwise agreed in advance

  • Delays or additional capture time resulting from inaccessibility, incomplete preparation, operational interruptions or restricted access may incur additional charges

  • The Producer will make every reasonable effort to work within site constraints but accepts no liability for incomplete capture resulting from access restrictions not disclosed prior to booking

Scope and Revisions

  • Project pricing includes one consolidated round of revisions following delivery unless otherwise stated in the project proposal. Revision requests must be submitted in a single communication

  • Additional revision requests beyond the included round are billed at the Producer's standard hourly rate as stated in the project proposal

  • Work outside the agreed project scope including new spaces, full platform rebuilds, and third party integrations will be quoted separately

  • Third party integrations including but not limited to booking systems, CRM platforms, ticketing systems or custom development are excluded from standard project scope unless explicitly stated in the project proposal

Platform and Hosting

  • Virtual tour services may be delivered via third party platforms including but not limited to Matterport and MPskin. C i Media accepts no liability for changes to third party platform pricing, availability, features or terms of service

  • Where ongoing hosting or platform management is included or contracted, services may be suspended in the event of non-payment until outstanding amounts are received

  • Hosting and platform pricing is based on current infrastructure and subscription allowances at the time of quoting. Significant changes in requirements may require revised pricing with reasonable notice provided to the client

  • Raw capture data is retained for 90 days following project completion unless otherwise agreed. Requests for data outside this period cannot be guaranteed

  • Where the client elects to migrate to client-owned platform infrastructure, a transfer and rebuild fee may apply. The Producer will provide a quote for this work on request

Intellectual Property and Usage

  • The copyright of all raw scan data, processed models and associated files remains with the Producer until the project is paid in full

  • Upon receipt of full payment, the client is granted a licence to use the delivered virtual tour platform for their intended purposes

  • Raw scan files and source data will not be released to the client unless otherwise agreed in writing

  • The client grants C i Media consent to reference and showcase completed projects for portfolio and promotional purposes unless otherwise agreed in writing prior to project commencement

  • The client confirms they have the necessary permissions and rights to have the specified spaces captured and published as virtual tours

Liability

  • The Producer will deliver services with reasonable skill and care in accordance with the agreed project brief

  • The Producer accepts no liability for incomplete or unsatisfactory capture resulting from access restrictions, site changes, or information not provided prior to the capture date

  • The Producer accepts no liability for platform outages, data loss or service interruptions caused by third party platforms

  • The total liability of the Producer in connection with any project shall not exceed the total fees paid by the client for that project
